Terms of Serving

1. Acceptance of Terms. These Terms of Service ("Terms") govern your access to and use of the websites operated by CoreReach Agency, a division of Rich's Property Images LLC ("CoreReach Agency," "we," "us," or "our"), including corereachagency.com and trial.corereachagency.com (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. About Our Services. The Site describes CoreReach Agency's digital marketing services, including but not limited to website visitor identification, search engine optimization (SEO), paid advertising management, website design, marketing automation, and reputation management. Content on the Site is provided for general informational purposes only and does not constitute a binding offer of services. Actual services delivered to clients are governed by a separate, signed Client Service Agreement — not by these Terms. If any conflict exists between these Terms and a signed Client Service Agreement, the Client Service Agreement controls with respect to service delivery, fees, and term.

3. Free Trial and Promotional Offers. CoreReach Agency may offer a free trial period (including, without limitation, a free 7-day website visitor identification trial) as described on the Site. Free trial offers are subject to the following: no payment is required to begin a free trial unless otherwise stated at the time of offer; CoreReach Agency reserves the right to modify, limit, or discontinue any free trial or promotional offer at any time without notice; completion of a free trial does not obligate you to purchase any paid service, and does not obligate CoreReach Agency to continue providing services beyond the trial period absent a signed Client Service Agreement; and any data, leads, or reports generated during a free trial are provided "as is," without warranty as described in Section 9 below.

4. SMS Messaging Program. By submitting your information through a CoreReach Agency web form (including trial.corereachagency.com) and opting in to SMS communications, you consent to receive text messages from CoreReach Agency. These messages may include marketing and promotional messages, appointment reminders and notifications, lead generation follow-ups, and account alerts. Consent to receive SMS messages is not a condition of purchasing any service. Message frequency varies. Message and data rates may apply. Check with your carrier for details. To stop receiving messages, reply STOP to any text message. For help, text HELP. Carriers are not liable for delayed or undelivered messages. No mobile opt-in data or phone numbers collected through this program will be shared with third parties or affiliates for marketing or promotional purposes. 5. Website Visitor Identification Technology. CoreReach Agency's services, and portions of the Site itself, may use technology designed to identify visitors to a website, which can include collecting information such as approximate identity, contact details, and browsing behavior of site visitors, using tracking technologies including cookies, pixels, and similar tools. By using the Site, you acknowledge that such technology may be present. Details on the categories of data collected, how it is used, and your choices regarding tracking technologies are described in our separate Privacy Policy, which is incorporated into these Terms by reference.

6. Eligibility and Acceptable Use. You must be at least 18 years old and capable of forming a legally binding contract to use the Site for business purposes. You agree not to: use the Site for any unlawful purpose or in violation of these Terms; attempt to gain unauthorized access to any portion of the Site, our systems, or related platforms; interfere with or disrupt the operation of the Site or servers/networks connected to the Site; use any automated system (bots, scrapers, or similar) to access the Site without our prior written consent; or misrepresent your identity or affiliation with any person or entity when submitting information through the Site.

7. Intellectual Property. All content on the Site — including text, graphics, logos, images, videos, and software — is the property of CoreReach Agency or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission, except as necessary to use the Site for its intended purpose. Any proprietary systems, processes, templates, or methodologies used by CoreReach Agency to deliver services remain the property of CoreReach Agency, as further described in any signed Client Service Agreement.

8. Third-Party Links and Services. The Site may reference or link to third-party websites, platforms, or services (including but not limited to advertising platforms, payment processors, and marketing technology providers) that are not owned or controlled by CoreReach Agency. We are not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of any third-party service is governed by that party's own terms and policies.

9. No Guarantee of Results; Disclaimer of Warranties. Digital marketing, advertising, and lead-generation outcomes depend on numerous factors outside CoreReach Agency's control, including market conditions, competition, platform algorithm changes, and a client's own follow-up and sales execution. CoreReach Agency does not guarantee specific numbers of leads, sales, rankings, traffic, or revenue outcomes from use of the Site or any service described on it. THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COREREACH AGENCY AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL COREREACH AGENCY'S TOTAL LIABILITY ARISING FROM YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100). This limitation does not apply to obligations under a signed Client Service Agreement, which are governed separately by that agreement's own liability terms.

11. Indemnification. You agree to indemnify and hold harmless CoreReach Agency, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Payment and Billing (Reference). Where the Site references pricing, subscription plans, or payment for services, actual billing is processed through our designated payment processor and is governed by the payment terms set out in your signed Client Service Agreement. Nothing on the Site itself constitutes a binding sale; a service relationship begins only upon execution of a Client Service Agreement and, where applicable, initial payment.

13. Changes to These Terms. CoreReach Agency may revise these Terms at any time by posting an updated version on the Site. Changes are effective immediately upon posting unless otherwise stated. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law. These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles, and any disputes arising from these Terms shall be resolved in the state or federal courts located in that state.

15. Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
